Building Services Maintenance: Service Catalog for Standard Sheet VDMA 24186

VDMA 24186 contains a service program for the maintenance of technical systems and equipment in buildings. Maintenance serves to preserve the intended condition and ensure availability. It forms the basis for safe, hygienic, and efficient system operation. All of this is an essential component of European and national legislation. VDMA 24186 is aimed in particular at maintenance personnel, operators, manufacturers, and planners of technical systems and equipment in buildings. It is also frequently an integral part of industry-specific software for building management. Users will find in VDMA 24186 a tool designed for practical use that serves to structure maintenance tasks, define the scope of services, and document the execution of maintenance.

The following parts are included:

• Ventilation and air conditioning technology 
• Heating technology 
• Refrigeration and heat pump technology Measurement and control technology and building automation 
• Electrical engineering 
• Plumbing 
• Fire protection

The VDMA offers the service catalogs in digital and editable form via a license agreement to anyone who works with building services systems. 

The following license agreements are available for different target groups:

• License agreement for end users (service companies, building operators, etc.) 
• License agreement for software solution providers (software companies)

For both contract types, a one-time license fee of 349.05 EUR plus VAT is required to obtain a license. In addition, there is an annual license fee depending on the contract type:

• End-user license agreement for up to 20 users: 349.05 EUR plus VAT 
• End-user license agreement for unlimited users: 698.10 EUR plus 
• VAT License agreement for software solution providers: 1,745.25 EUR plus VAT. 

After purchase, you will receive a ZIP file containing the service catalogs in Word and PDF formats, the services in Excel, and the logo for use within the scope of the license agreement: The licensee is entitled to make changes and additions. If a partial adoption occurs and/or changes and additions are made, the licensee is obligated to indicate this fact in accordance with the duty to provide notice under Section 4. The notice must clearly and unambiguously state that this is an adoption of VDMA 24186 that has been modified in scope and content.

Duty to Provide Notice

The Licensee undertakes to indicate the author’s copyrights to the licensed material in a suitable, prominent, and clearly visible location using a standard font size by including the following statement: 

“The VDMA 24186 standard sheet is protected by copyright. All rights are reserved by the VDMA Association of German Mechanical and Plant Engineering, Lyoner Straße 18, 60528 Frankfurt/Main. The entity responsible for the content is the Working Group on Building Services Maintenance within the General Air Technology Division of the VDMA. The contact person is Mr. Dipl.-Ing. (FH) Thomas Damm (Email: thomas.damm@vdma.eu).“ 

In addition, the VDMA logo must be displayed in the immediate vicinity of the above notice. The VDMA will provide the logo to be used. Any further use of the logo is expressly prohibited. If the licensee incorporates VDMA 24186 with modifications to its scope or content, they must indicate this in the manner described above using the following text: 

“The service catalogs for the maintenance of technical systems and equipment contained in the software are based on VDMA 24186. During the adaptation, modifications were made to the scope and content compared to the original edition of VDMA 24186. Users of the software and the documents generated with it are expressly advised of this fact.”

 Liability

The author has created the licensed materials to the best of his knowledge and belief. Defective deliveries for which the licensor is responsible will be replaced free of charge. If no replacement is provided, the licensee has the right to reduce the license fee or terminate the contract. Any further liability, in particular for damages not incurred to the licensed material itself, is excluded. This does not apply if the damage is based on an intentional or grossly negligent breach of contract by the Licensor. In the event of a culpable breach of material contractual obligations, the Licensor shall also be liable in cases of slight negligence, in the latter case limited to the reasonably foreseeable damage typical for this type of contract. Further claims are excluded. The Licensee is solely responsible for the technical implementation and the economic viability of the licensed subject matter.

Termination

The contract is concluded for an indefinite period and may be terminated by either party at the end of the year with six months’ notice. The Licensee is also entitled to a special right of termination in the following cases:

• Increase in the annual license fee 
• Withdrawal without replacement of an existing part within the VDMA 24186 series (§ 2c)

This special right of termination must be exercised in writing within 4 weeks of

• receipt of the invoice for the annual license fee, or 
• receipt of the notification regarding the withdrawal without replacement of a part

The right to terminate the contract immediately for good cause remains unaffected. The Licensee may terminate the contract immediately if the Licensor was not authorized to dispose of the rights to the licensed subject matter. The Licensor is entitled to such a right of termination in particular if: 

• the Licensee fails to pay the due license fee despite a reminder, 
• the Licensee makes changes to the content or design of the licensed subject matter in violation of §3(2), or 
• the Licensee culpably breaches other material contractual obligations toward the Licensor.
